Mr. Strzok was combative, and he pointed to an FBI lawyer in the room as reason not to disclose much of anything about his investigation into the Russia connections of the Trump campaign. Under pressure from Ohio’s Jim Jordan, Mr. Strzok did reveal that Justice Department official Bruce Ohr acted as a channel between the opposition-research firm Fusion GPS and the FBI in 2016. We already knew that Mr. Ohr’s wife Nellie worked for Fusion. This means that Fusion, an outfit on the payroll of the Clinton campaign, had a messenger on the government payroll to deliver its anti-Trump documents to the FBI. This confirms that the FBI relied on politically motivated sources as part of its probe, even as Mr. Strzok insists he showed no political bias in his investigating decisions. Yet if this is the most Congress could pry out of the FBI’s lead Russia investigator over 10 hours, legislative oversight won’t discover the truth. Mr. Trump will have to help Congress by ordering Justice and the FBI to declassify the relevant documents. Consistent with protecting legitimate sources and methods, here is the document list Mr. Trump should want released: • The FISA applications. Justice and the FBI made one application and three renewals for warrants against former Trump campaign aide Carter Page. The text of those applications would show the degree to which the FBI relied on the dossier compiled by Christopher Steele at the request of Fusion GPS. They would also show how honest FBI and Justice were with the Foreign Intelligence Surveillance Court that approves warrants. • Woods procedures documents. The FBI is required to vet and support the facts its presents to a FISA court when it seeks a warrant to eavesdrop on a U.S. citizen. These rules are known as Woods procedures, and releasing sections of this Woods file would show the extent to which the FBI verified the dossier or other evidence it used as its justification to listen to Trump campaign aides. More broadly, Mr. Trump should declassify any document that demonstrates what the FBI and Justice knew about the provenance and accuracy of the Fusion-Steele dossier. • The 302s. These forms include information taken from the notes FBI agents make while interviewing a source or subject. Senate Judiciary Chairman Chuck Grassley last week asked Justice to declassify the 302s for 12 separate FBI interviews with Mr. Ohr concerning his contacts with Mr. Steele. Declassifying other 302s related to the subjects in this probe (including former Trump aides George Papadopoulos, Michael Flynn ) would reveal what the FBI was told, who provided what information, and how much came from politically motivated sources. • The 1023s. These are the equivalent of 302s for counterintelligence, and they document FBI debriefings with informants or sources. Mr. Trump should declassify these and other documents showing interaction between the FBI and Mr. Steele, Fusion GPS founder Glenn Simpson, Fusion backer Dan Jones, informant Stefan Halper, or anyone the FBI used to keep tabs on the Trump campaign. These documents would reveal the extent and dates of the FBI investigation of the Trump campaign. Mr. Trump is undoubtedly being told that declassifying these documents would set a bad precedent, or risk accusations that he is undermining special counsel Bob Mueller’s investigation. But the worst precedent would be letting mistrust and partisan suspicion persist over how law enforcement behaved during a presidential campaign. Mr. Mueller’s probe is also moving ahead without interference, as his indictment Friday of a dozen Russian agents for hacking Democratic National Committee computers shows. But indictments of Russians who will never see a U.S. courtroom don’t tell us anywhere near the complete story. That duty falls to Congress, not to a special counsel whose job is deciding whether or not to prosecute crimes. Mr. Trump is going to be attacked no matter what he does. Special counsel Robert Mueller indicting 12 Russian intelligence officers, accusing them of hacking the DNC and the Clinton campaign in order to interfere in the 2016 presidential election, this as President Trump is gearing up to meet face-to-face with Russian President Vladimir Putin tomorrow in Helsinki. Joining me right now to talk about all of the above, House Intelligence Committee Chairman Devin Nunes. Mr. Chairman, it's always a pleasure to see you. REP. DEVIN NUNES, R-CALIFORNIA: It's great to be here live. I'm not coming from California. (LAUGHTER) BARTIROMO: I know. I'm happy. NUNES: It looks so different. BARTIROMO: It's great that you're on set. So thank you very much. These Russian indictments, we could have known about them earlier this year, when you actually came out with your report back in -- back in March, and then the findings released to the public at the end of April. I have got the report right in front of me. Your reaction to these indictments? NUNES: Well, we knew about this a year-and-a-half ago. Almost everything in the -- in the indictment, we knew about. In -- March 22, we released our findings that you have in front of you right there. Those findings were available March 22. If you remember, the media mocked us. BARTIROMO: Yes, I do remember. NUNES: They made fun of the Republicans. They said it was a whitewash. The Democrats said it was a whitewash. Nearly everything the Democrats said about our report was that it was a whitewash. Then we had to fight with the intelligence agencies and the Department of Justice, so that they wouldn't redact and they would declassify our report. That was finished in April. So, this entire report that you have in front of you, including -- all you had to do was get page four, and you only had to read chapter two, and you would have had nearly everything that's in the indictment. BARTIROMO: That is pretty incredible. Look at all these redactions that you can actually see on the screen. NUNES: And it's page after page of that. (LAUGHTER) NUNES: And, actually, there's more in this report. BARTIROMO: Yes. NUNES: Than what's in the indictment, OK? And this is what -- this is what's very frustrating. So -- so, it's great that they indicted Russians. Yes, they did bad things. I mean, they're always up to bad things. We know that. They have very sophisticated intelligence capabilities in Russia. And they are always -- they are constantly attacking the United States and our allies. However, in the indictment, they leave out some really important people that they also went after. So, the indictment plays like they're only going after the Democrats, when Bob Mueller and all his investigators and his lawyers know for a fact that they also targeted Republicans. Why is that not in the indictment? It makes the indictment look ridiculous. BARTIROMO: OK. So. (CROSSTALK) NUNES: Now, I'm not saying they shouldn't be indicted. I'm just saying that. BARTIROMO: That the Russians were targeting both Democrats and Republicans. NUNES: And Republicans. BARTIROMO: Yes. NUNES: And they know that. It's in our report. So why doesn't the -- why doesn't Department of Justice allow this to be declassified, so the American public can see this? BARTIROMO: The other thing is that these people are never going to see justice, right? I mean, we don't have jurisdiction over these -- these people. They're not going to come to the U.S. And so they really won't actually be held accountable. NUNES: Right. They're intelligence officers, so they're not going to be held accountable. It doesn't mean, though, that we shouldn't call out Russia for attacking our -- conducting cyber-attacks on our system. BARTIROMO: But the timing of this, I mean, they -- they released this right after the Peter Strzok hearing. And your point is, we knew all of this year ago. Why is now the time to make these arrests, and not a year ago, when you actually had the information? continued...
continued from above... NUNES: Well, I have to call into question. You knew about this a year- and-a-half ago. You for sure knew it because you got our report. So you for sure knew it by March and April of this year. And then it looks like all you did, all the Mueller did was validate our report, indict some Russians, and leave out, I think, some very pertinent, relative of -- evidence that the American public should see, which is why we continue to have to fight. This report has been mocked by the media, has been mocked by the Democrats, and still is mostly redacted by the Department of Justice and the intelligence agencies. BARTIROMO: And all of these redactions really underline a common theme. And that has been obstruction on the left. You look at that Peter Strzok trial last -- Peter Strzok hearing, rather, last week. And there was so much obstruction on the Democrats. They were trying to change the subject. They -- they were trying to stop the questioning of what went on during the 2016 election. So, how are you going to get the information, when you see you're in a catch-22 situation? Because every time -- you want to know why the Trump collusion investigation launched in the first place. But when you ask that question of Peter Strzok or anybody else in the FBI, they're going to say, we can't talk about it because it's an active investigation. And it is, by the special counsel. NUNES: Yes. So there's -- so, there's a couple points, I think, that are important. So, we have add before July 31 of 2016, we have asked the Department of Justice for months and months and months -- I have said on your show -- did you run informants? How many informants did you have before the investigation was even open? How much did you pay these informants to run into Trump campaign or officials or associates? Because the Department of Justice is trying to say -- and the FBI -- that they didn't do anything until after July 31. So that's -- we're still waiting on that information. I think that is really important information the American people should know. The second biggest problem we have is that the president of the United States has got to declassify this. Why was -- if the president of the United States would have declassified this -- if you go through page after page after page of this, OK, the Mueller indictment would look ridiculous today, if this was redacted -- if this was unredacted and declassified. BARTIROMO: Yes. Well, you know what? Because there is a big portion of the country that will say, oh, he's trying to get in the middle of an investigation, which is why I asked the president two weeks ago, when I sat down with him in that exclusive interview with President Trump, whether or not he's going to declassify these documents. Listen to this. (BEGIN VIDEO CLIP) BARTIROMO: Why don't you just direct your subordinates to get those documents over to Congress? Are you going to do it? DONALD TRUMP, PRESIDENT OF THE UNITED STATES: The one thing I want to stay uninvolved in, at least for now -- I may get involved. BARTIROMO: OK. TRUMP: But I've been told by so many people, don't get involved. You know, all those people got involved. BARTIROMO: Congress wants those documents. TRUMP: It's not good. And they'll get the documents, and it's getting, and they're getting them. (END VIDEO CLIP) BARTIROMO: Meanwhile, there an op-ed in this weekend's Wall Street Journal. And the title is, "After the Strzok Stone Wall," basically saying, we're obviously not going to get to the truth through the legal process. The president has got to declassify. Do you think he will do it? NUNES: Well, I think he has to. And I think this is a great example of it. It's not just about Strzok. It's not just about the FISA. Now you have information in our report here that he should have already declassified. And I think then the American people would have known. I mean, we basically wrote the indictment for Mueller. The House Republicans, without the support of the Democrats, wrote the indictment for the Mueller special counsel, essentially, and information that we have had for over a year. So, now you have Strzok, who's -- who is stonewalling Congress, not answering questions, looks very foolish. You add on to the fact that you still have the FISA that is sitting out there that should be declassified, so the American public can see it, because what is consistent in all of this investigation for a year-and-a-half? House Republicans come out and say something, and then we get attacked by the mainstream media, mocked by the mainstream media and the Democrats. But every time, when the truth eventually comes out, we're proven right. And we will be proven right again if the FISA -- majority of the FISA is declassified, so the American public can make up their mind, were the counterintelligence agencies abused by the Obama administration or were they not? BARTIROMO: Yes. And, at this point, we have got, what, 25 or 26 Russians that have been indicted, the number of Russians colluding with -- with Donald Trump, zero, five Americans indicted, four of them for lying to the FBI, and Manafort for a 20-year-old bank fraud. So there are reports today that the special counsel is looking to wrap this up by the end of the summer. Do you believe that? NUNES: I don't believe it. I mean, they look -- I hope that's the case, but they look way too political to me, because every time it seems like something comes out, Strzok or -- or, before that, we had when the FISA stuff came out, the special counsel always seems to be reactive to try to, I think, create narratives. And maybe that's not the case, but it sure looks like the case. BARTIROMO: So, where does your investigation stand now into the State Department and into really how this launch took place of the Trump-Russia probe? NUNES: We are -- we are waiting on the Department of Justice to give us that information before July 31, which, for week after week after week, they continue not to do it. They did provide a lot of documents that are -- that are aiding us in our investigation. And then we have kicked over 42 names. Strzok and Page are two of those 42 names. BARTIROMO: But, also, Glenn Simpson is on that list. NUNES: Yes. So, there's -- and those, we kicked to the task force from the Oversight Committee. And Mr. Ratcliffe is on this task force. We need these people interviewed on camera as soon as possible. BARTIROMO: Real quick, before you go, let me -- let me ask you in terms of what happens now and whether or not you think we're going to see accountability here. NUNES: I think you only see accountability if there is either a second special counsel that investigates all of this or there is somebody that is outside of the leadership of the Department of Justice who can run a -- a real investigation abuse of power and other issues. BARTIROMO: What should the president ask or speak to Putin about? NUNES: Well, the president has to be tough. Well, number one, I would say, don't hand a reset button over, like Hillary Clinton did. BARTIROMO: Yes, the big. (CROSSTALK) NUNES: That's number one. (LAUGHTER) NUNES: Number two, what he's doing with Europe and NATO is what's needed to be done for a long time, which is, one, pay your fair share. And, two, we cannot allow Eastern Europe to rely on German -- on Russian gas. The Germans are building pipelines, getting Russian gas, feeding the Russian beast, right, while the Germans are only paying 1.3 percent. BARTIROMO: Yes. NUNES: So, I laugh about all these people who are saying that Trump shouldn't meet with Putin. Trump has done more on the highest issues at the most important level, pointing them out to the Europeans and us, and the American people, that you have got to stop buying gas from Russians and you have to beef up defense in Poland, Romania and the Baltics. That's what needs to happen. And only by force, brute force will Putin understand anything. BARTIROMO: And. NUNES: And we should give the president the room to do that. BARTIROMO: And you would imagine that this -- obviously, these indictments are brought up as well. NUNES: Yes, I would guess. But -- but that's -- it's -- it's just ridiculous. Kenya has been one of the most stable democracies in Africa since the 1960s. The ethnic cleansing earlier this year was the worst violence in Kenya since that 1982 coup attempt. Mr. Odinga spent eight years in prison. At the time, he denied guilt but later detailed he was a coup leader in his 2006 biography. Statute of limitations precluded further prosecution when the biography appeared. Initially, Mr. Odinga was not the favored opposition candidate to stand in the 2007 election against President Mwai Kibaki, who was seeking his second term. However, he received a tremendous boost when Sen. Barack Obama arrived in Kenya in August 2006 to campaign on his behalf. Mr. Obama denies that supporting Mr. Odinga was the intention of his trip, but his actions and local media reports tell otherwise. He lashed out against the Kenyan government shortly after meeting with the president on Aug. 25. “The [Kenyan] people have to suffer over corruption perpetrated by government officials,” Mr. Obama announced. “Kenyans are now yearning for change,” he declared. Mr. Obama sent his foreign policy adviser Mark Lippert to Kenya in early 2006 to coordinate his summer visit. Mr. Obama’s August trip coincided with strategizing by Orange Democratic Movement leaders to defeat Mr. Kibaki in the upcoming elections. Mr. Odinga represented the ODM ticket in the presidential race. Mr. Odinga and Mr. Obama’s fathers were both from the Luo community, the second-largest tribe in Kenya, but their ties run much deeper. Mr. Odinga told a stunned BBC Radio interviewer the reason why he and Mr. Obama were staying in near daily telephone contact was because they were cousins. In a Jan. 8, 2008, interview, Mr. Odinga said Mr. Obama had called him twice the day before while campaigning in the New Hampshire primary before adding, “Barack Obama’s father is my maternal uncle.” President Kibaki requested a meeting of all opposition leaders in early January in an effort to quell the violence. All agreed to attend except Mr. Odinga. A month later, Mr. Kibaki offered Mr. Odinga the role of prime minister, the de facto No. 2 in the Kenyan government, in return for an end to the attacks. Mr. Odinga was sworn in on April 17, 2008. Mr. Obama’s judgment is seriously called into question when he backs an official with troubling ties to Muslim extremists and whose supporters practice ethnic cleansing and genocide. Putin Claims U.S. Intelligence Agents Funneled $400 Million To Clinton Campaign Vladimir Putin made a bombshell claim during Monday's joint press conference with President Trump in Helsinki, Finland, when the Russian President said some $400 million in illegally earned profits was funneled to the Clinton campaign by associates of American-born British financier Bill Browder - at one time the largest foreign portfolio investors in Russia. The scheme involved members of the U.S. intelligence community, said Putin, who he said "accompanied and guided these transactions." Browder made billions in Russia during the 90's. In December, a Moscow court sentenced Browder in absentia to nine years in prison for tax fraud, while he was also found guilty of tax evasion in a separate 2013 case. Putin accused Browder's associates of illegally earning over than $1.5 billion without paying Russian taxes, before sending $400 million to Clinton. After offering to allow special counsel Robert Mueller's team to come to Russia for their investigation - as long as there was a reciprocal arrangement for Russian intelligence to investigate in the U.S., Putin said this: For instance, we can bring up Mr. Browder, in this particular case. Business associates of Mr. Browder have earned over $1.5 billion in Russia and never paid any taxes neither in Russia or the United States and yet the money escaped the country. They were transferred to the United States. They sent [a] huge amount of money, $400,000,000, as a contribution to the campaign of Hillary Clinton. Well that’s their personal case. It might have been legal, the contribution itself but the way the money was earned was illegal. So we have solid reason to believe that some [US] intelligence officers accompanied and guided these transactions. So we have an interest in questioning them. ........ Browder, a media favorite who self-promotes as “Putin’s enemy #1,” portrays himself as a selfless human rights advocate, but is he? He has used his fortune to threaten lawsuits for anyone who challenges his version of events, effectively silencing many critics. He claims that his accountant Sergei Magnitsky was a crusading "lawyer" who discovered a $230 million tax-fraud scheme that involved the Browder business interest Hermitage Capital but was, in fact, engineered by corrupt Russian police officers who arrested Magnitsky and enabled his death in a Russian jail. Many have been skeptical of the Browder narrative, suspecting that the fraud was in fact concocted by Browder and his accountant Magnitsky. A Russian court recently supported that alternative narrative, ruling in late December that Browder had deliberately bankrupted his company and engaged in tax evasion. He was sentenced to nine years prison in absentia. William Browder is again in the news recently in connection with testimony related to Russiagate. On December 16th Senator Diane Feinstein of the Senate Judiciary Committee released the transcript of the testimony provided by Glenn Simpson, founder of Fusion GPS. According to James Carden, Browder was mentioned 50 times, but the repeated citations apparently did not merit inclusion in media coverage of the story by the New York Times, Washington Post and Politico. ........Fusion GPS, which was involved in the research producing the Steele Dossier used to discredit Donald Trump, was also retained to provide investigative services relating to a lawsuit in New York City involving a Russian company called Prevezon. As information provided by Browder was the basis of the lawsuit, his company and business practices while in Russia became part of the investigation. Simmons maintained that Browder proved to be somewhat evasive and his accounts of his activities were inconsistent. He claimed never to visit the United States and not own property or do business there, all of which were untrue, to include his ownership through a shell company of a $10 million house in Aspen Colorado. He repeatedly ran away, literally, from attempts to subpoena him so he would have to testify under oath. Buchanan Beginning his joint press conference with Vladimir Putin, President Trump declared that U.S. relations with Russia have “never been worse.” He then added pointedly, that just changed “about four hours ago.” It certainly did. With his remarks in Helsinki and at the NATO summit in Brussels, Trump has signaled a historic shift in U.S. foreign policy that may determine the future of this nation and the fate of his presidency. He has rejected the fundamental premises of American foreign policy since the end of the Cold War and blamed our wretched relations with Russia, not on Vladimir Putin, but squarely on the U.S. establishment. In a tweet prior to the meeting, Trump indicted the elites of both parties: “Our relationship with Russia has NEVER been worse thanks to many years of U.S. foolishness and stupidity and now, the Rigged Witch Hunt!” Trump thereby repudiated the records and agendas of the neocons and their liberal interventionist allies, as well as the archipelago of War Party think tanks beavering away inside the Beltway. Looking back over the week, from Brussels to Britain to Helsinki, Trump’s message has been clear, consistent and startling. NATO is obsolete. European allies have freeloaded off U.S. defense while rolling up huge trade surpluses at our expense. Those days are over. Europeans are going to stop stealing our markets and start paying for their own defense. And there will be no Cold War II. That is another underlying message here: America is coming home from foreign wars and will be shedding foreign commitments. Both before and after the Trump-Putin meeting, the cable news coverage was as hostile and hateful toward the president as any this writer has ever seen. The media may not be the “enemy of the people” Trump says they are, but many are implacable enemies of this president. Some wanted Trump to emulate Nikita Khrushchev, who blew up the Paris summit in May 1960 over a failed U.S. intelligence operation — the U-2 spy plane shot down over the Urals just weeks earlier. Khrushchev had demanded that Ike apologize. Ike refused, and Khrushchev exploded. Some media seemed to be hoping for just such a confrontation. When Trump spoke of the “foolishness and stupidity” of the U.S. foreign policy establishment that contributed to this era of animosity in U.S.-Russia relations, what might he have had in mind? Was it the U.S. provocatively moving NATO into Russia’s front yard after the collapse of the USSR? Was it the U.S. invasion of Iraq to strip Saddam Hussein of weapons of mass destruction he did not have that plunged us into endless wars of the Middle East? Was it U.S. support of Syrian rebels determined to oust Bashar Assad, leading to ISIS intervention and a seven-year civil war with half a million dead, a war which Putin eventually entered to save his Syrian ally? Was it George W. Bush’s abrogation of Richard Nixon’s ABM treaty and drive for a missile defense that caused Putin to break out of the Reagan INF treaty and start deploying cruise missiles to counter it? Was it U.S. complicity in the Kiev coup that ousted the elected pro-Russian regime that caused Putin to seize Crimea to hold onto Russia’s Black Sea naval base at Sevastopol? Many Putin actions we condemn were reactions to what we did. Russia annexed Crimea bloodlessly. But did not the U.S. bomb Serbia for 78 days to force Belgrade to surrender her cradle province of Kosovo? How was that more moral than what Putin did in Crimea? If Russian military intelligence hacked into the emails of the DNC, exposing how they stuck it to Bernie Sanders, Trump says he did not collude in it. Is there, after two years, any proof that he did? Trump insists Russian meddling had no effect on the outcome in 2016 and he is not going to allow media obsession with Russiagate to interfere with establishing better relations.
