If you are not fulfilling the 3 requirements for it to be mortal sin, you are still very much part of the Kingdom of God.
We believers are actually called to a higher standard for Jesus said whoever looks at a woman lustfully has already commited adultery in his heart. It is from within that the seeds of sin sprout so we need to pray for the grace to identify the roots of sin within our souls.

If some one murders another we can call them murderers. If someone commits adultery they are adulterers. To state that some acts are intrinsically evil makes a judgement of the action.

Those that are divorced and remarried and who refuse to live as brother and sister and refrain from sexual relations are, unless they are invincibly ignorant, living in a state of mortal sin. Pope Francis could have used Amoris Latetia as a teaching moment for these people and educated these ignorant people. Tell me, Smudger, where in Amoris Latetia does Pope Francis spend time educating the invincibly ignorant with the Catechism of the Catholic Church?
Whether or not a divorced and remarried Catholic who refuses to refrain from sexual relations meets all three requirements for mortal sin is IRRELEVANT to the issue at hand. If invincible ignorance was the central issue of Amoris Latetia, then all Pope Francis would have to do is direct these ignorant people to read the Catechism of the Catholic Church. Instead, Kasper and Company are trying to create a pathway for the divorced and remarried (who do not live as brother and sister) to recieve Holy Communion with Church approval.
